Delaware AG rules officers were justified to use deadly force, wound home invasion suspects

The Delaware attorney general’s office has concluded that New Castle County police officers were justified in using lethal force earlier this year during a confrontation with armed suspects attempting to escape a home invasion. In the January incident, David Salasky III, whose father is serving two life sentences for the killing of New Castle County Police Lt. Joseph Szczerba in 2011, was among the suspects involved. A 911 call was made around 1:45 a.m. on Jan. 22, reporting armed individuals in a home attacking roommates. Responding officers encountered the suspects as they tried to flee, with one carrying a .22 caliber rifle. Officers Sean Sweeney-Jones and Ryan Archangelo discharged their weapons, hitting Alistair DiPasquale and Evan Chandler. Salasky and Michael Edgerton retreated inside the home and escaped out the back.

Officer Alejandro Guillen fired a shot at Salasky, who was armed, but Salasky was unharmed. Edgerton and DiPasquale managed to flee but were apprehended later. Chandler and DiPasquale sustained injuries during the incident.

The report revealed that Sweeney-Jones fired his weapon 14 times, while Archangelo fired five shots. This home invasion occurred just over two years after Sweeney-Jones was involved in another lethal force incident, where Lymond Moses was fatally shot after fleeing from officers in a vehicle.

The criminal cases against the suspects are still ongoing, with investigators determining that the use of lethal force was justified in both incidents.
